Priskribo
English: Family portrait taken circa 1944. The family of Suleiman ben Pinhas al-Cohen (the elderly man sitting), and his son, Salam (Shalom) Cohen, sitting next to him with a baby in his arm. Standing next to Salam is his sister, Sham’a (Shoshanna Bedihi). In Yemen, the father and his son worked in silver gilded with gold (Ar. asli), the only family in Sana’a to work in this profession.
Other information
Copies of the original photo were made and distributed to members of the family, before Rumia (the wife of the photographer, Yihi’el Haiby) bequeathed her deceased husband’s photographic collection to the Israel Museum in Jerusalem. This image, however, is now in the public domain because its term of copyright has expired in Israel. According to Israel's copyright statute from 2007 (translation), “a work is released to the public domain on 1 January of the 71st year after the author's death (paragraph 38 of the 2007 statute) with the following exceptions: ##A photograph taken on 24 May 2008 or earlier — the old British Mandate act applies, i.e. on 1 January of the 51st year after the creation of the photograph (paragraph 78(i) of the 2007 statute, and paragraph 21 of the old British Mandate act).” Since this photograph was made in Yemen in the circa 1944, more than 70 years have transpired since its creation.

This work or image is now in the public domain because its term of copyright has expired in Israel (details). • A photograph taken on 24 May 2008 or earlier — the old British Mandate act applies, i.e. on 1 January of the 51st year after the creation of the photograph (paragraph 78(i) of the 2007 statute, and paragraph 21 of the old British Mandate act).

You must also include a United States public domain tag to indicate why this work is in the public domain in the United States. Note that a few countries have copyright terms longer than 70 years: Mexico has 100 years, Jamaica has 95 years, Colombia has 80 years, and Guatemala and Samoa have 75 years. This image may not be in the public domain in these countries, which moreover do not implement the rule of the shorter term. Honduras has a general copyright term of 75 years, but it does implement the rule of the shorter term. Copyright may extend on works created by French who died for France in World War II (more information), Russians who served in the Eastern Front of World War II (known as the Great Patriotic War in Russia) and posthumously rehabilitated victims of Soviet repressions (more information).

This non-U.S. work was published 1929 or later, but is in the public domain in the United States because either
  • it was simultaneously published (within 30 days) in the U.S. and in its source country and is in the public domain in the U.S. as a U.S. work (no copyright registered, or not renewed),

or

  • it was first published outside the United States (and not published in the U.S. within 30 days) and
  • it was first published before 1978 without complying with U.S. copyright formalities or after 1978 without copyright notice and
  • it was in the public domain in its home country on the URAA date ( January 1, 1996 for most countries).

This work may still be copyrighted in other countries.

For background information, see the explanations on Non-U.S. copyrights. Note: in addition to this statement, there must be a statement on this page explaining why the work is in the public domain in the U.S. (for the first case) or why it was PD on the URAA date in its source country (second case). Additionally, there must be verifiable information about previous publications of the work.
